These Terms and Conditions govern your use of this website and your engagement with the services offered by Patinafold. By using this website or booking a programme, you confirm that you have read, understood, and agreed to these terms. If you do not agree, please do not use this website or engage our services.
1. Definitions
- "Patinafold", "we", "us", "our" — refers to Patinafold, a sole proprietorship registered in Malaysia and operating from 21 Jalan Tun Sambanthan, 30000 Ipoh, Perak.
- "You", "Client", "User" — refers to any individual or family engaging our services or using this website.
- "Services" — refers to the archive organisation workshops and programmes offered by Patinafold, including the Dating and Labelling Workshop, the Layered Archive Build, and the Strata Register Programme.
- "Agreement" — refers to these Terms and Conditions together with any booking confirmation or written programme engagement.
- "Family Papers" — refers to documents, photographs, correspondence, and records belonging to the Client and brought to or accessed during a programme session.
2. Acceptance of Terms
By submitting an enquiry, booking a programme, or attending a session, you confirm that you are at least 18 years of age and have the legal capacity to enter into this Agreement. If you are engaging on behalf of a family group, you confirm that you have authority to do so on behalf of all relevant parties.
Use of this website constitutes acceptance of these terms in relation to the website. Engagement of a programme constitutes acceptance of all terms relevant to service delivery.
3. Description of Services
Patinafold offers educational workshops and clerical organisation programmes to help families in Perak, Malaysia, understand, date, label, and index their own documents and photographs. All Services are:
- Educational or clerical in nature only
- Not legal, financial, valuation, or professional advice of any kind
- Conducted only on documents and materials provided by the Client
- Subject to the scope described in the programme outline at the time of booking
Services are available to families located in Perak, Malaysia. Home visits within central Ipoh are included in the programme fee; a travel supplement applies for other Perak locations and will be confirmed in writing before booking is finalised.
4. Client Responsibilities
- You are responsible for providing accurate contact and booking information.
- You confirm that you have the right to bring the Family Papers to a session and to permit Patinafold staff to handle and scan them for the clerical purpose of the programme.
- You are responsible for providing suitable storage (USB drive, cloud account, or similar) to receive any scanned copies produced during a session.
- You must not use the website or our Services for any unlawful purpose.
- You must not misrepresent the nature of any documents brought to a session or the identity of the Client.
5. Intellectual Property
All content on this website — including text, layout, the dating worksheet format, glossary, and register format — is the intellectual property of Patinafold and is protected under applicable Malaysian intellectual property law.
Clients receive a personal, non-transferable licence to use the printed materials (worksheets, glossaries, register formats) provided during a programme for their own family archive purposes. These materials may not be reproduced, distributed, or used commercially without the prior written consent of Patinafold.
6. Payment Terms
All prices are quoted and payable in Malaysian Ringgit (RM). Current programme fees are:
- Dating and Labelling Workshop: RM 432 (payable before the session)
- Layered Archive Build: RM 1,120 (50% deposit on booking; balance before the second appointment)
- Strata Register Programme: RM 3,940 (25% deposit on booking; remainder by equal monthly instalments at each review)
Accepted payment methods will be confirmed at the time of booking. Patinafold reserves the right to adjust programme fees; any increase will not apply to confirmed bookings already in progress.
Cancellation and Refunds
- Cancellations made more than 7 days before a session: full refund of any amount paid, less a RM 50 administrative fee.
- Cancellations made 3–7 days before a session: 50% refund of the session fee paid.
- Cancellations made less than 3 days before a session: no refund, unless Patinafold reschedules at its own initiative.
- Deposits for multi-session programmes are non-refundable once the first session has been delivered.
7. Programme-Specific Terms
7.1 Scope
Each programme is delivered within the scope described in its outline. Patinafold will not, under any circumstances, offer legal advice, valuation, financial advice, or professional opinion on any document. If a Client requests this during a session, they will be referred to the practitioner directory.
7.2 Document Handling
Patinafold handles Family Papers with care, using practices appropriate to paper and photograph preservation in Perak's climate. We accept no liability for pre-existing damage to documents.
7.3 No Retention
Scanned copies produced during a session are transferred to the Client's own storage during that session. Physical papers are returned to the Client at the end of each appointment. Patinafold retains no copies of Family Papers after each session.
8. Disclaimers
The Services are provided as described. Patinafold does not warrant that:
- Any dating or labelling produced during a programme will be accepted as conclusive by any third party, authority, or court
- The organisation of Family Papers will produce any particular legal or financial outcome
- This website will be available without interruption or error
Nothing on this website or communicated during a session constitutes legal, financial, valuation, or professional advice. Clients requiring such advice are directed to qualified registered practitioners.
9. Limitation of Liability
To the maximum extent permitted by Malaysian law, Patinafold's total liability to the Client in respect of any claim arising from the Services or this Agreement shall not exceed the amount paid by the Client for the programme in respect of which the claim arises.
Patinafold is not liable for any indirect, consequential, or special loss arising from the use of this website or the Services, including any loss resulting from reliance on the output of a programme in a legal, financial, or professional proceeding.
10. Indemnification
You agree to indemnify and hold harmless Patinafold and its staff from any claims, losses, or expenses (including reasonable legal costs) arising from your breach of these Terms, your misrepresentation of the nature of Family Papers, or your use of the Services or this website in a manner that is unlawful or in violation of any third party's rights.
11. Termination
Either party may terminate a programme engagement in writing with reasonable notice. If Patinafold terminates a programme that is already in progress for reasons other than the Client's breach, a pro-rata refund of prepaid amounts will be provided. If the Client terminates, the cancellation policy in Section 6 applies.
Sections 5, 8, 9, 10, and 13 of these Terms survive termination of any engagement.
12. Dispute Resolution
These Terms are governed by the laws of Malaysia. In the event of a dispute, the parties agree to attempt to resolve it informally by writing to [email protected] in the first instance. If informal resolution is not achieved within 30 days, disputes shall be referred to the courts of Malaysia, with Ipoh, Perak as the preferred jurisdiction.
Nothing in this clause prevents either party from seeking urgent injunctive or other equitable relief from a court of competent jurisdiction.
13. General Provisions
- Entire agreement: These Terms, together with any written programme booking confirmation, constitute the entire agreement between the parties and supersede any prior representations.
- Severability: If any provision is found to be unenforceable, the remaining provisions continue in full force.
- Waiver: Failure by Patinafold to enforce any provision does not constitute a waiver of that provision.
- Assignment: You may not assign your rights under this Agreement without our written consent. We may assign our obligations to a successor business with reasonable notice.
- Notices: Written notices to Patinafold should be sent to [email protected] or by post to 21 Jalan Tun Sambanthan, 30000 Ipoh, Perak, Malaysia.
14. Changes to These Terms
We may update these Terms from time to time. Updated terms will be posted on this page with a revised "Last Updated" date. Continued use of this website or engagement of Services after an update constitutes acceptance of the revised terms. We will make reasonable efforts to notify Clients with active programme bookings of any material changes.
